1. Acceptance of Terms

By downloading, installing, or using Jamaica Plants ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

Jamaica Plants is a mobile application that allows users to:

• Photograph plants and receive AI-assisted species identification via the PlantNet service
• View on-device generated information about identified plants
• Save a personal library of plant scans
• Share plant discoveries and engage with a community of plant enthusiasts

3. Accuracy Disclaimer

Do not consume, handle, or use any plant solely based on information provided by this app. Some plants are toxic, allergenic, or dangerous. Always consult a qualified botanist, medical professional, or official authority before consuming or handling any plant.

We are not liable for any harm, illness, injury, or damage resulting from reliance on plant identification results or generated information within the App.

4. User Accounts

To access certain features you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Ensuring that all information you provide is accurate and up to date

You must be at least 13 years old to create an account. We reserve the right to terminate accounts that violate these Terms.

5. Free Tier and Subscriptions

Free Tier: Free users may perform up to 3 plant scans in total. To scan more plants, a subscription is required.

Jamaica Plants Pro: A paid subscription that provides unlimited plant scans and removes all advertisements. Subscription details, pricing, and billing cycles are displayed within the App prior to purchase.

• Subscriptions are billed on a recurring basis (monthly or annual, as selected)
• You may cancel your subscription at any time; access continues until the end of the current billing period
• Refunds are subject to the platform's standard refund policies
• We reserve the right to change subscription pricing with reasonable advance notice

6. User-Generated Content

By posting content (photos, captions, comments) to the community feed, you:

• Confirm you own or have rights to the content you post
• Grant us a non-exclusive, royalty-free licence to display that content within the App
• Agree not to post content that is offensive, misleading, abusive, or illegal

We reserve the right to remove any content that violates these Terms without prior notice.

7. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose
• Harass, threaten, or abuse other users
• Post spam, misleading information, or malicious content
• Attempt to reverse-engineer, scrape, or exploit the App or its APIs
• Impersonate another person or entity
• Use automated tools to circumvent scan limits or access controls

8. Intellectual Property

All content, branding, design, and code within the App — excluding user-generated content — is the property of Jamaica Plants and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

9. Third-Party Services

The App integrates with third-party services including PlantNet (plant identification) and Firebase (infrastructure). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.

10. Limitation of Liability

To the fullest extent permitted by law, Jamaica Plants and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

• Incorrect plant identifications
• Loss of data or content
• Service interruptions or downtime
• Actions taken based on AI-generated information

The App is provided "as is" and "as available" without warranties of any kind, express or implied.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, without notice or liability. You may also delete your account at any time via the Settings screen in the App.

12. Governing Law

These Terms are governed by the laws of Jamaica. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Jamaica.
